Magmatic: "horned animal" ride-on case not infringed by tiger and ladybird competitors
As promised, here's a note on the ruling of the Court of Appeal for England and Wales inMagmatic Ltd v PMS International Ltd [2014] EWCA Civ 181, which was decided last Friday. In short, the court held, reversing the decision of the trial judge, that the defendant's ride-on suitcase for children known as the "Kiddee Case" did not infringe the claimant's Community registered design (CRD) for another ride-on suitcase known as the "Trunki".
DPMA - trade mark statistics for 2013 Some trade mark statistics for our readers' delectation before the weekend. The German Patent and Trademark Office (DPMA) has issued a press release concerning trade mark filings and registrations for 2013. 60161 trade mark applications were filed at the DPMA – an increase of 0.5% compared to 2012- and 43507 trade marks matured to registration – a decrease of 5.6% compared to 2012.

However, from time to time, a Judge decides to sit down and devote her precious time to a case in order to explain meticulously the reasons of its decision, the applicable law and how this is construed by other Courts, resulting in an important piece in the case-law in the corresponding field of law.
