MARQUES raises concerns over TM reforms
|
 MARQUES has submitted comments on the latest developments regarding trade mark reforms in Europe.
|
|
The comments, published on 21st March and available on the EU Task Force minisite, cover the Lithuanian Presidency Compromise Proposal of 19th November 2013 and the Greek Presidency Compromise Proposal of 20th February 2014.
The comments cover 20 general issues including: - OHIM governance and tasks; budget surplus; cooperation on projects; and fees
- Goods-in-transit
- Grouping of goods and services; implementation of IP Translator
- Absolute and relative grounds for refusal; administrative opposition and cancellation procedures
- Term of use; surrender; and grace period
MARQUES also raises concerns regarding the inclusion of lists and specific references, including to fees, in the Regulation.
The European Parliament had its first reading in February (see last month’s HouseMARQUES). The next stage in the process is for the Council to finish its proposals/amendments to the Commission's proposals.
The EU Task Force will therefore focus attention on the Council over the next few months. When the Council has finished its deliberations, the Trilogue (the Parliament, the Council and the Commission) will start.
“We expect to have to continue to be active and watch developments for the rest of the year and probably into 2015. Stay tuned,” says Tove Graulund, chair of the Task Force.
