International Registrations Containing a Designation of the United States of America: Courtesy Email Reminders of the Requirement to File Affidavits of Continued Use in Commerce Before the United States Patent and Trademark Office (USPTO) Holders of international registrations designating the United States of America are required to periodically affirm the continued use of the mark in commerce, in respect of the goods and services for which protection has been granted. Failure to do so through an affidavit can result in invalidation of protection under US law. To facilitate the smooth filing of affidavits of continued use in commerce, the USPTO has provided information to WIPO on how holders can receive courtesy email reminders. Holders are encouraged to use the USPTO Change of Correspondence Address Form to indicate/update the email address to which the USPTO can send courtesy email reminders. To do so, holders need to enter the corresponding US application serial or US registration number. These numbers can be found in the statement of grant of protection sent by the USPTO under Rule 18ter(1) or (2) of the Common Regulations.
