Among the changes coming into effect on 1st October are the abolition of the graphical representation requirement and the introduction of the EU certification mark

The EU Trade Mark Regulation was amended in March 2016, but a number of those amendments will only start to apply on 1st October 2017. On this date, a codified version of the EU Trade Mark Regulation will come into force, as well as two pieces of secondary legislation – an Implementing Regulation and a Delegated Regulation – which supplement the provisions of the EU Trade Mark Regulation and replace the existing Implementing Regulation. More informationThe MARQUES European Trade Mark Law & Practice Team reviewed the EU Commission’s initial drafts of the Implementing Regulation and the Delegated Regulation and provided comments on the same. Team Chair Robert Guthrie and Vice-Chair Petra Goldenbaum have authored a blog post addressing: What are the changes and what do trade mark owners and their advisors need to do? EUTM changes at the Annual ConferenceDimitris Botis, Deputy Director for Legal Affairs at EUIPO, provided an update on the changes at the MARQUES Annual Conference in Prague. He explained how various types of marks can now be represented, why faxes are being phased out for trade mark filings and renewals and what the new rules on appeals mean. Barrister Simon Malynicz of Three New Square also discussed key aspects of the changes, including representation of colour combination marks, certification marks and changes regarding acts of agents or representatives.
