Judges Meeting in Belgrade

The first MARQUES meeting with judges and other trade mark experts in Serbia took place on 31 May at the Office for Intellectual Property, and was attended by about 40 people

Those attending were welcomed by Gregor Versondert, Chair of the MARQUES Council, and Vladimir Maric, Director of the Office for Intellectual Property. There were three sessions focusing on different topics, namely: trade mark infringement proceedings; goods in transit and parallel imports; and determination of trade mark infringement. General discussion took place during a fourth session.
Each session included a judge as well as another expert, and there were also judges and assistants in the audience. “We had quite a few judges sitting in the audience and actively participating in the discussion,” said Vuk Sekulic of MSA IP, who moderated one of the sessions. In Serbia, there are now two courts in charge of trade mark infringement disputes, both in Belgrade, and this specialisation has improved the quality of judgments. But there are still challenges: for example, court decisions are not published regularly. Zorana Joksovic of MSA IP, who moderated the closing discussion, said the event was unique in providing a forum for judges and practitioners to interact and discuss current issues: “It was very positive that judges participated actively and indicated that they may also take part in similar events in the future.”
