Report on IP right bundles
The European Observatory on Infringements of Intellectual Property Rights has published a new study on firms' simultaneous use of patents, trade marks and registered designs to protect their innovation.
The study, Use of IPR Bundles by EU Firms 2014-2015, is based on a sample of more than 63,000 companies across all EU Member States. It found that 8.3% of the firms in the sample have applied for more than one type of IP right, and 1% applied for all three types during the period. It also found that 45% of design filings come from firms also filing trade marks, but most trade marks (nearly 80%) are filed by firms that file only trade marks but not designs or patents. Patents are the IP right that is most often used together with other rights. Firms filing both trade marks and patents filed nearly 4 patents for every trade mark; firms filing both designs and patents filed 6.5 patens for every design. Multi-IP right firms represent 31.9% of employment and 35.5% of turnover in the sample. Firms filing all three types represent 14.1% of employment and 16% of turnover. The study also found that larger firms are more likely to be multi-IP right businesses: more than 20% of large firms have filed more than one type of IP right, compared to only 7% of SMEs. However, there are differences between sectors: 15% of firms in "Å“manufacturing and mining" are multi-IP right firms, compared to only 6% of firms in 'services, "commerce and utilities".
