Customs recordal in Kenya
|
The MARQUES Anti-Counterfeiting and Parallel Trade Team has formed a sub-group to obtain clarification on the mandatory Customs recordal system that has been introduced in Kenya. The deadline of 1 January 2023 is the date on which IP rights have to be recorded to comply with the local legislation
|
The main issues on which clarification was sought included the type of IP rights to be registered, the costs of registration, the duration of the recordal, and the effect of non-registered rights on the entry of products at the borders as well as the capacity to effectively manage the registration process and the roles of the different authorities to effectively implement the recordal system. The authorities were also asked to clarify whether there will be a transitional period while the new system is being implemented and to update the website with the latest developments. We have been advised that the recordal validity period will be considered further and that a notice will be issued in the near future regarding the transitional period. It is clear that the deadline will not be extended further and that brand owners should take the necessary steps to register house marks and/or the main trade marks that are likely to be affected by counterfeiting activities.
