Enforcement of IP rights: Approximately 86 million fake items were detained in the EU in 2021, an increase of almost 31% compared to 2020. But the estimate value of fake items detained was 3% lower at €1.9 billion. The five most detained products, in terms of number of items detained, were packaging material, cigarettes, labels, clothing and toys. Italy detained 39% of the fake items (worth 41% of the total estimated value). The report, compiled by the EUIPO and European Commission, is based on figures from police, Customs and market surveillance authorities. It includes information on industry and geographical trends. New evidence rules: From 1 February 2023 new requirements will apply when submitting annexes on data carriers, such as USB flash drives, pen drives or similar memory units. Other changes to rules on submitting evidence mean that only unlayered PDFs (not encrypted, executable or compressed files) are acceptable and 20 Mb is the maximum size of each individual file saved on the data carrier.
