Prickly issue? Cactus of Peace appeal heads for CJEU ruling
The decision of the General Court in a genuine-use opposition, Case T-24/13 Cactus S.A v OHIM, Del Rio Rodriguez, is being appealed to the Court of Justice of the European Union (CJEU). The appeal concerns an application to register the figurative sign “Cactus of peace”, displayed on the right, in Classes 31, 39 and 44 of the Nice Agreement. According to the appellant, OHIM erred in its classification of this mark.
The case has a new CJEU reference number, C-501/15 P. As usual, the UK Intellectual Property Office invites informed comments:
"If you would like to comment on this case please email policy@ipo.gov.uk by 5 January 2016".
