Similar marks on wine and glasses not likely to cause confusion says ECJ
The Court of Justice of the European Communities ruled today in Case C‑398/07 P, Waterford Wedgwood plc v Assembled Investments (Proprietary) Ltd, Office for Harmonisation in the Internal Market, that the mark on the right, for which Assembled Investments had sought Community trade mark protection for wines from the Stellenbosch region of South Africa (Class 33) was not likely to be confused with the earlier Communiyt trade mark consisting of the word WATERFORD for glass (Class 21). According to the Court, upholding the decision of the Court of First Instance, the respective goods were neither similar nor complementary.
