Finland: centralized IPR court one step closer
The proposal of the working group concerning the centralization of IPR matters to the Market Court is ready and has been published (in Finnish) on the website of the Ministry of Justice. The working group proposes that the Market Court would get broad competence to handle IPR-related matters of any kind, starting in 2012.
For trademark practitioners this court reform means that in the future any appeals must be filed with the Market Court instead of the Board of Appeal of the National Board of Patents and Registration, which will be dismantled after it has handled all currently pending matters. However, if the centralization project is proceeding in time, the Market Court and the Board of Appeal will work side by side for a couple of years as there is currently a large backlog of work at the Board and it is estimated that the last file might not be closed until in 2014.
The working group has also made some suggestions concerning the procedural matters. According to the proposal the basic line-up of the Market Court would consist of three judges.
The aims stated in the working group´s proposal are certainly worth striving for but it will still take some time to see the final outcome as the implementation of the proposed changes needs financial resources from the budget funds.
