MARQUES ACTA workshop
This morning MARQUES's winter meeting, held in the Hotel Melia Castilla, Madrid, opened with a workshop on the Anti Counterfeiting Trade Agreement (ACTA), with Carles Prat (Baker & McKenzie) in the chair and John Anderson (Pakharenko & Co UK) and Keri Johnston (Johnston Wassenar LLP, Toronto) leading the programme.
John Anderson (Pakharenko & Co UK) opened by explaining the background and evoluation of ACTA and why a trade-related treaty such as TRIPS was not inherently suitable as a milieu for strengthening enforcement provisions. Keri Johnston then took over, discussing some of ACTA's key provisions and pointing out some of the faultlines that divide member states, such as the protection of geographic indications.
There then followed a lively discussion, which turned on the unlikelihood that ACTA would ever serve its purpose, the fact that its copyright provisions were more cogent than those governing trade marks, the question whether the emphasis is shifting from private to public enforcement, and whether it might develop into something better. The need for education of judges, enforcement agencies and indeed governments was stressed.
