Misleading invoices issue - UKIPO report on "landmark agreement" between ASA & UK's Trading Standards
Misleading invoices sent to trade mark applicants are a well-known "evil" in our industry. On its website the UK IPO now reports of a recent Advertising Standards Authority’s (ASA) ruling in the case of a private trade mark renewals firm's mailings. Upon a complaint, the ASA held that a mailing referring to a trade mark renewal was misleading "as it was not clear it had been sent by a private company with no affiliation to the Intellectual Property Office".
More information on this matter and on a recent "landmark agreement" between ASA & the UK's Trading Standards on Misleading Invoices can be found here. In summary: Trading Standards have agreed to act as ASA's “legal backstop” in relation to any non-broadcast advertisers who continue to break the rules on misleading advertising. Good news!
