Greece: Consumers know their Italian when it comes to wine and spirits
A rather ambitious attempt to register the marks "Vino Bianco", "Vino Rosato", and "Vino Rosso" in Greece for spirits (excluding beer) in Class 33 met the resistance of the competent Examiner. The marks included certain stylization (see left for Vino Bianco - the other marks differed only in color), which was however held incapable of lifting the burden of distinctiveness in these particular cases.

 

The applicant's argument that Greek consumers will not attribute any particular meaning to the word elements of the respective marks was rejected: The Examiner held that the relevant words are "basic words of the Italian language" and known to the average Greek consumer who will understand them as mere indications of the nature and qualities of the products designated.  Bottom's up!
