Poland: fakes for poor people
The Polish newspaper Rzeczpospolita reports a recent legislative initiative regarding Polish Customs law and the issue of selling goods detained at the border. The proposed changes will allow for the sale or destruction of such goods after a preliminary injunction that was granted for smuggled products is changed to a court order declaring forfeiture of the property. However, any counterfeit products can be destroyed without filing a request to declare forfeiture. The Customs are not allowed to sell such goods, which may be donated to orphanages or charitable organizations after receiving the trade mark onwer's consent -- followed, for instance, by the removal of any labels and signs.
