CheckMobile's appeal for Carcheck rejected
The General Court confirmed in case T-14/10 that the word mark CARCHECK lacks distinctive character for goods and services in Classes 9, 16, 38, 41, 42 and 45. In the Judgment, the Court upheld the Board’s findings regarding in particular Class 42 services ‘conception and development of software’, on the grounds that the expression CARCHECK clearly makes reference to the inspection, technical or economic control of automobiles, or the previous check of a car’s history before purchase, which is thus descriptive for the contested services.
