BGH on class 16 similarity in: "ZOOM"
The German Federal Court of Justice, short BGH (case reference: I ZB 77/13 of 3 July 2014, ZOOM) recently held the following concerning a potential similarity of class 16 goods:
"The goods ‘paper for copying purposes’ (Papier für Kopierzwecke) and the goods ‘Print media, namely, pamphlets, printed matter, in particular newspapers, magazines and books, photographs’ (Printmedien, nämlich Druckschriften, Druckerzeugnisse, insbesondere Zeitungen, Zeitschriften und Bücher, Fotografien) are not similar in the sense of Article 9 (1) No. 2 German Trade Mark Act."
