Greece: Beverly Hills, the home of plastic surgery!
The Greek TM Office has rejected the mark below for goods and services in Classes 5, 41 , and 44, essentially covering a plastic surgery practice.
Although, there may be some debate as to the impact of the figurative element on the overall ipression created by the mark (this blogger's opinion is that it does not offer much), it is interesting to note that the rejection of the mark was mainly because "the mark informs consumers directly, without the need for a second thought, that the services designated are plastic surgery services orginating from Beverly Hills". That does not really seem quite rights, does it?
One may think that the evocative attempt BEVERLY HILLS = plastic surgery is too poor to make the distinctiveness cut, but a desingation of geographical provenance....
