Darjeeling dispute to be appealed to CJEU
The Court of Justice of the European Union (CJEU) has been asked to hear an appeal in Joined Cases C-673/15 P, C-674/15 P, C-675/15 P & C-676/15 P: The Tea Board v OHIM. This is the celebrated (or notorious, depending on your perspective) decision that an application for figurative mark for Darjeeling, in respect of lingerie, would take unfair advantage of figurative marks for Darjeeling in respect of tea (see Class 46 here for a review of the decision under appeal).
The General Court decisions under appeal are in Cases T-624/13, T-625/13, T-626/13 and T-627/13.
