If you are involved in filing trade mark applications using NFTs and the metaverse, you may be interested in new information from EUIPO.
As Class 46 blogger Christian Tenkhoff reported here, the EUIPO released guidance on the classification of items relating to “virtual goods” and “non-fungible tokens” in July.
The Office published further information in a “Practice tip” in the September edition of its Alicante News newsletter (see page 6).
It is also presenting a webinar on “Trade marks and designs in the Metaverse: legal aspects/EUIPO practice” on 13 September.
The webinar starts at 10.00 Alicante time and will be presented by Kelly Bennett and Thom Clark of the EUIPO Legal Department. It will be in English and last for one hour.

EUIPO states: “During this webinar you will receive a brief insight into what the metaverse and NFTs are, followed by a highlight of the areas of EUTMs and RCDs that are most impacted by this new world. You will find out what the Office is currently doing in relation to registration proceedings, and you will be asked to contribute to discussions on what it could and should be doing.”
The EUIPO says it has been registering applications using NFTs and the metaverse since last year. It registered 1,277 applications using NFTS in 2021 and 1,157 so far in 2022. It has also registered 205 applications using metaverse so far this year.
