It is not uncommon that enforcement of designs is met by a counterclaim of invalidity (lack of novelty and/or individual character). The session will address how the EUIPO allows the introduction of evidence of disclosure through mediums such as the Wayback Machine and will compare and contrast this treatment of introducing evidence of disclosure (prior art) with that used by the European Patent Office.

Member of the MARQUES Designs Team

11.15 PART 6 - IN A CHANGING WORLD DO “TAX HAVENS” HAVE A FUTURE?
The past five years have seen significant changes in the global tax environment. The next couple of years are likely to be equally significant, with intellectual property driving much of the debate. Traditionally, many companies held their valuable IP in “tax havens”. With an increasing alignment between where a company carries out its activities and its taxable profits, where does that leave the role of a tax haven? Are we likely to see a shift of IP away from traditional tax havens to “onshore” locations? What will drive these decisions and what will it mean for a company’s tax bill?
  SESSION CHAIR:
Patricia McGovern, DFMG Solicitors, Ireland
Member of the MARQUES Dispute Resolution team
  SPEAKERS:
Peter Vale, Grant Thornton, Ireland
Lodewijk Berger, Jones Day, The Netherlands
