China plays an important role for European companies as it is the second most important business partner of the EU. As China applies the first-to-file principle to trademarks, it is important to register your trademark as soon as possible. However, as Chinese is the mother tongue in China, having a Chinese name and trademark is crucial in this market. Legal history has shown us that if a company does not have a Chinese language trademark, the market will create a name. If that name is consequently registered by someone else, enormous legal conflicts will arise. Furthermore, other conflicts can arise if there are problems with the meaning of the trademark. In order to overcome Chinese legal and Chinese language problems, and in order to show which considerations are important with Chinese translations and transliterations, this workshop will discuss how to make the correct translation and transliteration for your Chinese trademarks.

Members of the MARQUES China Team will share their experiences and discuss strategies.

Programme:

Mirjam will introduce the topic and the speakers and set the stage for the workshop.
Tingxi Huo, Chofn IP, China
Tingxi will present on Chinese language trademarks and on how to design a Chinese language name and trademark. Practical examples will be given during the presentation. Furthermore, successful and also unsuccessful case swill be discussed. Finally, the case of nicknames in China for foreign brands will also be addressed.
Hens J. de Koning-Ghijsen, Senior Legal Counsel & Global IP Manager, Heineken International BV, The Netherlands
Hens has taken Heineken through the process of Chinese names and transliterations for various brands. As such, she will share her rich experience in this area, and will also focus on how to talk with management on these various translations and transliterations.
Reinout van Malenstein, Senior Counsel, HFG Law Firm & IP Agency, China
As a European lawyer, fluent in the major European languages and Chinese, and graduated in both EU law and Chinese law, Reinout will discuss Chinese translations and transliterations from a European perspective, focusing on how to make the right decisions in the legal and language process.
Panel discussion and Q&A
The speakers will take part in a panel discussion, and MARQUES members can ask the team any questions they may have regarding Chinese translations and transliterations.
