Before Brexit, the Registered
Community Design (RCD) and Unregistered Community Design (UCD) was fully
valid and frequently used in the UK.
After Brexit on January 1, 2021, RCDs have ceased protection in the UK
and registered design protection in the UK can be achieved through the
UK’s own Registered Design right.
RCDs filed before 31 December 2020 still cover the UK as these design
rights have been automatically converted into a UK design, UCDs, will
continue to cover the UK for a limited period in some circumstances.
However, brand owners now need to seek registered and unregistered
design protections are available in the UK.
While the national UK and EU design systems include many similarities,
there are also some important differences.
In our workshop, we would like to highlight the most significant
differences and provide guidance how to successfully register design
rights in both jurisdictions.
