11.00    PART 6 - GIs AND TRADEMARKS - PRESERVING HERITAGE IN A CHANGING WORLD
Geographical indications are one of the most dynamic frontiers of IP law. As the EU's extension of GI protection to craft and industrial products reshapes the regulatory landscape, practitioners and rights holders face new strategic questions at the intersection of GI law, trade mark rights and international trade. This session explores these developments through three perspectives: An overview by the EUIPO of the new EU protection system for craft and industrial GIs and the latest developments in the Office's practice on conflicts between trade marks and geographical indications; Portugal’s transition to the new EU framework for craft and industrial GIs; the worldwide protection and enforcement of the "SWISS" GI for watches; and an overview by the EUIPO.
  SESSION CHAIR:
Alessandro Sciarra, Bird & Bird, Italy
Chair of the MARQUES Geographical Indications Team
  SPEAKERS:
Elisa Zaera Cuadrado, Business Operations Department, EUIPO
Teresa Pais Coelho, oriGIn Portugal, Portugal

The workshops are repeated at 15.30hrs to allow you to attend 2 workshop sessions

  WORKSHOP SESSION 1
The evolving role of amicus curiae
This workshop will not be repeated.
Presented by the MARQUES Amicus Curiae Team
The workshop will explore the evolving role of amicus curiae in shaping IP protection across Europe and beyond. Through the discussion of recent and illustrative decisions, the session will analyse why, when and how amicus submissions are made. Participants will gain insights into when and how amicus curiae interventions can effectively support consistent interpretation of IP rights, balance competing interests, and contribute to fair enforcement practices.

Workshop 1 - "Catch the copycats - practical strategies to enforce IP rights at trade fairs"
Presented by the MARQUES Unfair Competition Team
Trade fairs can offer trade mark owners unique opportunities to stop copycats and counterfeits, as swift and effective measures can be implemented right at the fair by court orders, customs, police and even by the trade fair organisers if actions are prepared in good time. This workshop will provide an overview of available rights and litigation strategies, such as preliminary injunctions, customs detentions and mediation proceedings. It will take a comparative and practical approach looking at the position in Germany, Spain, France, Italy, Brazil, the USA and Switzerland..

Workshop 2 - "Protecting voice, image and identity in the age of AI: deepfakes and AI-generated identity exploitation"
Presented by the MARQUES Famous & Well Known Marks Team
This workshop will provide a comparative overview, based on a survey covering more than 28 jurisdictions, on the evolving protection of voice, image, likeness and other identity rights in the AI era. The session will address AI-generated representations, deepfakes (including image and voice cloning), unauthorised commercial exploitation of identity, transferability and licensing of identity exploitation rights, and post-mortem protection issues. An entertainment industry expert is expected to address the protection and commercial exploitation of celebrity names and related identity attributes. The discussion will also explore available remedies, enforcement tools and practical strategies to address unauthorised AI-generated uses of personal identity.

Workshop 3 - "AI and marketing"
Presented by the MARQUES Brands & Marketing Team
This interactive workshop will explore a marketing campaign scenario inside a company, with practical examples of AI and IP related challenges that need to be addressed as the campaign is conceived, developed and launched.

Workshop 4 - "Improving the UDRP"
Presented by the MARQUES Cyberspace Team
With participation from the WIPO Domain Dispute Team plus ICANN, this workshop will consider proposed changes to UDRP practice and policy.
