To ensure and improve the legal position of brand owners in particular by pushing for harmonization of laws and practices at international, regional and national level.
The European Trade Mark Law and Practice Team's mission is to represent the interests of brand owners in relation to developments in trade mark law and practice in Europe. This encompasses monitoring and making recommendations on proposals at the European and EU level and taking part in meetings organised by institutions such as EUIPO. The Team often publishes position papers on relevant issues and canvasses the MARQUES membership for views on proposed changes. Robert Guthrie is a partner in Osborne Clarke's Intellectual Property group in London. Rob advises on all aspects of intellectual property protection, enforcement and dispute resolution. He has considerable experience of litigation in the UK across the range of intellectual property rights. Rob is a member Osborne Clarke's Digital Business, Retail and Life Sciences and Healthcare sector groups and works with clients in the media, fashion, betting and gaming and other industries.
Riccardo’s intellectual property practice started in 2009 and has focused on the protection and registration of trademarks and designs as well as on opposition, invalidity and revocation proceedings before the European Union Intellectual Property Office – EUIPO and the Italian Patent and Trademark Office.
He also resolves disputes in and out of court and handles anticounterfeiting, customs surveillance and contracts.

Petra Goldenbaum studied law in Hamburg and worked as an in-house counsel for six years with Rotring, a german brand owner with international business activities in the field of writing, office and drawing. In April 1999 she joined CMS Hasche Sigle, a German law firm with a traditional focus on IP. As a head of the trade mark department of the Hamburg office, Petra's main area of practice is trade mark law, including litigation and preliminary injunction and primarily specialising in trade mark prosecution worldwide.

Paolo is Senior Counsel in the London office of Locke Lord LLP and a member of the Firm's intellectual property, and trademark, copyright and advertising practice groups. His practice focuses on a wide range of trademark matters, including oppositions, revocations and invalidity actions, negotiating settlements, brand clearance and the prosecution of trademark portfolios worldwide.
Before joining the Firm, Paolo worked in the trademarks and brand protection group of a city firm. Prior to that, he worked in the European competition and regulation department of a magic circle firm. Jana is a German Certified IP lawyer and and a partner at D Young in Munich. She advises clients on national and international trademark, design, copyright and unfair competition law. Jana has particular experience in advising clients on their international trademark and design protection strategy as well as multi-jurisdictional IP enforcement. She has also been working with the EUIPO and as in-house lawyer in various companies in the past. Further, Jana is co-author of a Trademark Law Commentary and regularly contributes to various IP related publications.
Ellen has expertise within trademark, design, and domain name protection and is Head of Trademarks and European Trademark & Design Attorney at Plougmann Vingtoft. Ellen has worked in private practice since 2005 and before that, she worked for 8 years at the Danish Patent and Trademark Office where she ended up as head of the section responsible for the development of legal practice for trademarks and designs. Ellen frequently writes and speaks on European trademark law and practice and has until recently taught IP law at the Faculty of Law at the University of Copenhagen as an assistant professor.
Franco de Barba
Franco is partner with MERX IP in Spain. He counsels and advises clients on trademarks and industrial design issues from both an International, European and Spanish perspective. He develops strategies for acquiring, enforcing and assigning IP rights, and litigates national and international conflicts. He also focuses on strategic counselling in the course of trademark development, name finding processes and prosecution before IP Offices. Franco practises in both English, French and Spanish.

Paula studied law at the University of Deusto. Having passed her undergraduate exam, she earned a Master’s degree in International Law at ISDE (Instituto Superior de Derecho y Economía) in Madrid. She then did an internship at the Spanish Patent and Trademark Office, where she worked in the legal Coordination and International Relations Department. After this she coursed the Magister Lvcentinvs Master’s degree in Industrial and Intellectual Property at the University of Alicante. She joined BALDER and is now head of the foreign trademark department and also deals with European Union trademarks and proceedings.

As a member of the Paris Bar since 2003 and the New York Bar since 1996, she represents clients in diverse industries, including personal care products, sports and entertainment, publishing, telecommunications and apparel. Augusto is an Intellectual Property Counsel at Amazon, based in Luxembourg. He has a double cursus: he studied Law in Brazil and qualified as a Brazilian Lawyer. He then studied law in France and earned a Master’s degree in IP at Panthéon-Assas University, in Paris, as well as his qualification as French and European trademark and design attorney. Before joining Amazon in 2019, Augusto worked for 8 years for a top-tier French IP private practice and then 3 years for Signify (Philips Lighting).
